Public agreement on the provision of an SSL certificate
1.Terminology
1.1. Unless otherwise specified in this Agreement, the following capitalized words in this Agreement are definitions of this Agreement and have the following meanings in the singular:
1.1.1. Website means a website on the Internet under the domain name https://Hosting.UA/domain-names, both in full and any part of it;
1.1.2. A domain name is a part of the hierarchical address space of the Internet that has a unique name that identifies it;
1.1.3. Registry means an information and technical system of data processing on the Internet to which information on the Domain Name is entered and other information may be entered;
1.1.4. Registration means entering information about the Domain Name into the Registry;
1.1.5. Server is a software and hardware computer system that performs service functions by providing access to certain resources on the Internet and, in terms of access conditions and the number of users accessing such a system, may be divided into a general (public server), virtual dedicated (virtual dedicated server), physical (dedicated physical server);
1.1.6. Hosting - the use of tools for placing data on the Server;
1.1.7. SSL Certificate is a digital document that allows the Server and the Customer to verify each other's authenticity for further exchange of information in encrypted form;
1.1.8. Price - the price of the SSL Certificate set by the Contractor;
1.1.9. Tariff plan - service parameters that are set by the Contractor and include a particular Price for certain parameters of the SSL Certificate;
1.1.10. Customer - the person who receives the SSL Certificate;
1.1.11. Contractor - the person who provides the SSL Certificate;
1.1.12. Order - an electronic message to the SSL Certificate sent by the Customer from the Site and in the form on the Site;
1.1.13. Administrator means a person who establishes the terms and conditions of the Domain Name circulation and operation of the Registry;
1.1.14. Registrar - the Contractor or other person who checks the Order for compliance with the terms and conditions of the Administrator;
1.1.15. Registrant - the Customer or other person for whom the Registration is completed;
1.1.16. Personal Account - a section of the Site, access to which is provided to the Customer after the formation of the Order, which may contain information about the Customer, a list of active services, a list of invoices paid by the Customer, a list, date, content of electronic messages sent by the Contractor to the Customer and may contain other information;
1.1.17. Login - a set of characters specified by the Customer in the e-mail address, which serve as the Customer's identifier for access to the Personal Account;
1.1.18. Box means the Customer's e-mail address, the character set of which is the Login;
1.1.19. Password - a set of characters unique to the Website, specified by the Customer according to the Website's capabilities, which, in addition to the Login, serve as the Customer's identifier for access to the Personal Account;
1.1.20. Confirmation - an electronic message about the Order sent by the Contractor to the Box;
1.1.21. Instruction - an e-mail message with information on setting up the Order sent by the Contractor to the Box;
1.1.22. Supplier is a certification authority that provides an SSL certificate.
1.2. Unless otherwise specified in this Agreement, when using the plural definition of this Agreement in this Agreement, its meaning is identical to its meaning in the singular, but taking into account the number of the plural.
2.Evidence
2.1. The Customer confirms that the Customer:
2.1.1. Provide accurate information in the Order;
2.1.2. Make a conscious choice of the Tariff plan without violating the property and non-property rights of any person and having sufficient information about the Contractor, the Supplier, the Terms of use of the virtual hosting services and the Internet, which are posted on the Website, the terms and conditions of the Personal Account, the Domain name circulation, the functioning of the Registry;
2.1.3. Acknowledges that the Administrator has the right to establish, change the rules and conditions of the Domain Name circulation, functioning of the Registry, and the Contractor and the Supplier have the right to establish, change the rules and conditions for the provision of the Hosting and SSL Certificate;
2.1.4. Acknowledges that the Administrator, Contractor, Supplier, Registrar have the right to block, terminate the operation of the Domain Name, Hosting, SSL Certificate and take other actions against the Customer in case of violation by the Customer, Registrant of the rights of any person, the Terms of Use of the virtual hosting services and the Internet, which are posted on the Website, terms and conditions of the Domain Name circulation, operation of the Registry, including in case of infringement of intellectual property rights in connection with the Domain Name, sending Spam, posting illegal, unlawful materials on the Domain Name, including pornography, propaganda of hatred (interethnic, interracial, interethnic), terrorism, drugs;
2.1.5. Acknowledges that the Domain Name may be blocked, deleted or re-delegated by the Registrar, and the Hosting and SSL Certificate may be terminated in cases and in the manner prescribed by law;
2.1.6. Realizes that the SSL Certificate is considered to be provided from the moment the Customer activates the selected SSL Certificate using the Personal Account;
2.1.7. I am interested in non-disclosure of information regarding the Login, Password, Authorization Information, conditions of access to the Personal Account, and the Box;
2.1.8. Acknowledges that disputes regarding the SSL Certificate will be resolved in accordance with the legislation of Ukraine;
2.1.9. Notified and agrees to the composition and content of Personal Data to be processed in connection with the SSL Certificate;
2.1.10. Notified and agrees to the purposes and purposes of processing for which the Personal Data is intended, as well as the legal basis for processing Personal Data in connection with the SSL Certificate;
2.1.11. Notified and agrees to the transfer of Personal Data to the Contractor for the purpose of the SSL Certificate;
2.1.12. Notified and agrees to the storage of Personal Data by the Contractor during the term of the SSL Certificate and until the Personal Data is deleted in accordance with the law;
2.1.13. Notified and agrees to the Contractor's right to store Personal Data after deleting information about the Customer in accordance with the legislation of Ukraine, including during the statute of limitations established by law, and, if necessary, to use Personal Data as evidence in order to protect the legitimate rights and interests of the Contractor, including in cases involving the Registrar and/or the Registrant;
2.1.14. Notified and agrees to the rights of the Contractor as a subject of Personal Data provided for by the current legislation of Ukraine and/or the general data protection regulations, which, among other things, may be published on the Site;
2.1.15. Notified and agrees to the requirements, restrictions and other conditions set forth in this document immediately at the time of issuance of the SSL Certificate.
3. Subject.
3.1. Under this Agreement, the Contractor undertakes to provide the Customer with the opportunity to order a personal SSL certificate for the Domain Name in accordance with the Confirmation upon receipt of the relevant payment from the Customer provided for by this Agreement.
3.2. The Customer is obliged, within 2 days from the date of sending the Order and receiving the Confirmation, to pay in the monetary unit of Ukraine or other currency in compliance with the legislation of Ukraine the funds of the Price set in the Confirmation by transferring the relevant funds to the current account of the Contractor on the terms specified by the Contractor, indicating the number of the Confirmation in the relevant transfer document.
3.3. The Customer independently transmits information by entering data into the provided SSL certificate order form in the Personal Account, in accordance with the received Instructions.
3.4. To extend the term of the SSL Certificate, the Contractor shall send a Confirmation (regarding the extension of the term) to the Box at least 5 days before the expiration of the SSL Certificate. The Customer shall, no later than the date of expiration of the SSL Certificate, pay the Price specified in the Confirmation (for the extension of the term) in the monetary unit of Ukraine or other currency in compliance with the legislation of Ukraine, by transferring the relevant funds to the current account of the Contractor on the terms specified by the Contractor, indicating the number of the Confirmation (for the extension of the term) in the relevant transfer document. In case of timely payment by the Customer for the next period, the SSL Certificate shall be deemed to be provided from the moment the Customer extends the selected SSL Certificate in the Supplier's registration center through the Personal Account, in accordance with the received Instruction.
4. Procedure
4.1 The Customer shall, no later than 1 day from the date of receipt of the notice from the Contractor to provide information and documents in connection with the implementation of the SSL Certificate, verification of the Customer's identity, provide the Contractor with a response and relevant information and documents.
5. Disclaimers
5.1. The Contractor shall have the right at any time during the term of the SSL Certificate to refuse to further provide the SSL Certificate in any such case:
5.1.1. The Customer has provided the Contractor with incomplete, false information/documents for the SSL Certificate;
5.1.2. The Customer has not provided the Contractor with the information and documents specified by the Contractor for the SSL Certificate;
5.1.3. The Customer has performed/is performing actions that contain signs of actions or are such actions that violate the law, may cause losses, damage to the Contractor or any person;
5.1.4. The Customer carries out activities in the territory of the Russian Federation, the Republic of Belarus and/or activities in support of the Russian Federation, the Republic of Belarus and/or activities related to aggression against Ukraine;
5.1.5. The Contractor has received relevant recommendations from the authorities and other authorized entities.
5.2. The Customer shall have the right at any time during the term of the SSL Certificate to refuse to further receive the SSL Certificate, regardless of the reason.
6. Calculations
6.1 The price is indicated on the Website, in the terms of the Tariff Plan, and/or in the Confirmation.
6.2. The funds of the Price shall be considered paid to the Contractor at the moment of their crediting to the current account of the Contractor and display in the Personal Account.
6.3. All expenses for payment of the Price to the Contractor shall be paid by the Customer.
6.4. The Contractor may change the Price before receiving the funds of the Price.
6.5. The provision of an SSL Certificate may be confirmed by an act of services rendered.
6.6. The SSL Certificate is considered to be provided from the moment of its activation by the Customer through the Personal Account.
6.7. No interest shall be accrued or paid on the funds of the Price paid to the Contractor.
7. Information
7.1. The Contractor shall have the right at any time without obtaining a separate consent of the Customer to process Personal Data, include Personal Data in the relevant database of the Contractor's personal data, publish such data in open sources and process such data in accordance with the purpose established by the Contractor, the legislation of Ukraine and in compliance with the legislation of Ukraine.
8. Documentation
8.1. The Customer shall, no later than 5 days from the date of receipt of the copies of the act of services rendered signed by the Contractor, sign the relevant copy and send it to the Contractor or provide a reasoned refusal to issue the act of services rendered.
9. Rights and obligations
9.1. The Customer is obliged to comply with the Terms of use of shared hosting services and the Internet, which are posted on the Website, as well as to properly fulfill the obligations assumed, including under the legislation of Ukraine.
9.2. The Contractor shall be obliged to properly fulfill its obligations, including under the laws of Ukraine.
9.3. The Customer has the right to properly exercise its rights, including under the legislation of Ukraine.
9.4. The Contractor shall have the right to properly exercise its rights, including under the laws of Ukraine.
10. Responsibility
10.1. The Customer shall be liable to the Contractor under the laws of Ukraine, international law and this Agreement.
10.2. The Contractor shall be liable to the Customer on the terms of the legislation of Ukraine, international law and this Agreement, but only within the limits of the Price received from the Customer.
10.3. The Contractor shall not be liable in any such case:
10.3.1. for events and actions, inaction, decisions of any persons beyond the Contractor's control, including actions, inaction, decisions of the Administrator;
10.3.2. for illegal actions of the Customer, including actions related to the violation of intellectual property rights;
10.3.3. for restrictions, loss of the Customer's ability to access the Personal Account through no fault of the Contractor;
10.3.4. for debts, losses, costs, expenses of the Customer (including all court costs, fees, expenses for the services of attorneys, lawyers) arising as a result of extrajudicial, pre-trial, court proceedings, decisions directly or indirectly related to the SSL Certificate.
11. Term
11.1. Unless otherwise provided by this Agreement or the law, this Agreement for a separate Order shall enter into force from the moment the Contractor sends the Confirmation to the Box and shall be valid until the SSL Certificate is completed, but not less than until the obligations under this Agreement are fully fulfilled.
12.Termination
12.1. In case of violation by the Customer of its obligation to pay the Price, this Agreement shall be terminated the day after the expiration of the term of the obligation violated by the Customer. If the Contractor has grounds for refusing to further provide the SSL Certificate, this Agreement may be terminated at the initiative of the Contractor and shall be terminated the day following the day the Contractor sends an e-mail to the Box about the termination of this Agreement. If the Customer has grounds for refusing to further obtain the SSL Certificate, this Agreement may be terminated at the initiative of the Customer and shall be terminated the day following the day of receipt by the Contractor of the Customer's written notice of termination of this Agreement.
12.2. In case of termination of this Agreement at the initiative of the Customer within 30 days from the date of conclusion of this Agreement, the Contractor shall return/pay the Price to the Customer in the monetary unit of Ukraine or other currency in compliance with the legislation of Ukraine within 30 days from the date of termination of this Agreement by transferring the relevant funds to the current account of the Customer specified by the Customer. No interest shall be accrued or paid in connection with the deferred payment.
12.3. In case of termination of this Agreement at the initiative of the Customer after 30 days from the date of conclusion of this Agreement, the Contractor shall not pay the Customer any payments, including the refund of the Price, unless otherwise provided by this Agreement or the law.
13.Legislation
13.1. The laws and regulations of Ukraine shall apply to this Agreement.
13.2. From the moment of conclusion of this Agreement, discussions, arrangements, agreements between the Customer and the Contractor that may have taken place before the conclusion of this Agreement and which relate to the subject matter of this Agreement shall become null and void.
